Terms of use
Welcome as a user of Exakta Photo AB's web shop for school photos.
As a user of Exakta Photo, the following applies:
You are a user with your unique email address, which is used for any order confirmations and for "forgot password". If you have several children, you add their photos under the same user and thereby keep all your school photos in one place.
Consent to and information about the processing of your personal data
1.1. By ticking the box accepting the terms of use, I consent to Exakta Photo AB processing my or my child's personal data as set out below. Your personal data is not used for third-party marketing.
1.2. By ticking the box, I also confirm that I am either over 14 years of age and can therefore give consent to the processing myself, or that I am the guardian of the person under 18 to whom the consent relates and that both I and any other guardian of the child give my/our consent to the processing.
1.3. Exakta Photo AB is the controller for the processing. In this text Exakta Photo AB is referred to as "We" and the data subject as "You".
1.4. We will process the personal data to enable you to view the photos we have taken via our website and to enable you to buy photos and other products from us.
1.5. The data processed is the photos taken during school photography, name, personal identity number (for invoice payment), address, email address and phone number, as well as information about any orders you place with us and the information you provide if you contact us.
1.6. The data has either been collected directly during school photography or obtained from your school/preschool.
1.7. If you do not order any products from us, the data will be processed by us at most until the end of the calendar year following the year in which consent was given, or until you withdraw your consent.
1.8. If you place an order with us, the data will, instead of being processed on the basis of your consent, be processed to fulfil the agreement we then enter into with you – that is, to produce photos, send them to you and administer payment – and thereafter for marketing purposes, in order to market our products to you. Such processing will take place for at most one year after our customer relationship with you has ended.
1.9. If photos are ordered by the guardian of the person photographed, the orderer's personal data will be processed to fulfil the agreement we enter into with them, in the same way as the data we process about you.
1.10. When the data is processed for marketing purposes only, this is based on a balancing of interests where we consider that our interest in marketing our products to you is a legitimate interest that makes the processing permissible.
1.11. The data may be disclosed to companies that help us with the production and distribution of school photo products, such as printers and letter and parcel carriers.
1.12. You have the right to be informed free of charge about what data we process about you and to access the data we have registered by contacting us.
1.13. If you believe any data about you is incorrect, you have the right to request that it be corrected. In that case, contact us and tell us which data you think is incorrect and why it should be corrected.
1.14. You can also request that the processing of your personal data be restricted (frozen) if you believe the personal data we process is inaccurate, if the processing is unlawful, if we no longer need to keep or process the data but you still need it to establish legal claims, or if you have objected to the processing and until we have handled your objection.
1.15. While our processing of your personal data is based solely on your consent, you can withdraw your consent at any time by contacting us. If you withdraw your consent, the personal data we have registered about you will be deleted (the right to be forgotten). The same applies while we process your data for marketing purposes only after the customer relationship between us has ended.
1.16. If you believe our processing of personal data is incorrect, you have the right to lodge a complaint with the Swedish Authority for Privacy Protection (IMY), which is the supervisory authority. More information is available at www.imy.se.
1.17. Our contact details are Exakta Photo AB, 559259-3866, Brännögatan 5, 211 24 Malmö, Sweden, tel: 0431-44 56 00, info@exaktaphoto.se.
Right to object to processing for marketing purposes
1.18. You can object at any time to processing for marketing purposes. If you do, your personal data will be deleted.
